The customer offers to employ the maintenance services of Vaneron Garden Center on the terms set out below.
This agreement covers any plants supplied by Vaneron Garden Center.
Vaneron Garden Center will provide a weekly maintenance service with the following scope of work:
Cleaning of leaves, pots and
Application of pesticides when necessary
Removal of waste
Seeing to the overall upkeep of the display
Any plant failures or plant that overgrow their situations will be replaced free of charge. Different species of plants may be used as replacement providing these are of similar value and quality.
Vaneron Garden Center does not take any responsibility for stolen plants.
The monthly maintenance fee can be reviewed at the end of the contract period, based on a mutual agreement with the customer.
The contract will “run on” unless the customer requests in writing that the maintenance schedule be terminated at the end of the contract period.
All items listed and confirmed are subject to availability and satisfactory crop growth. We will do our utmost to report where problems develop with items confirmed.
Vaneron Garden Center retains ownership and beneficial of all plants supplied.
Every effort is made to ensure that plants dispatched are of first grade, quality and true to our name. However, in the event of a claim, Vaneron Garden Center liability shall not exceed the invoice price of the goods in question.
Vaneron Garden Center reserves the right to terminate this agreement and recover all plants; if the customer fails to pay falling due within the time specified by this agreement, or if the customer is in any other way in breach of the terms of this agreement. In the event of the agreement being terminated due to a breach by, or at the request of the customer, the customer shall be liable to pay the balance of the maintenance fees for the remainder of the original agreement. This payment must be made in full within 30 days of the termination of the agreement.
